EU/EEA/UK CONSUMER RIGHT OF WITHDRAWAL INFORMATION

Under applicable law, consumers in the European Union, the European Economic Area, and the UK have a right to withdraw from certain purchases for a refund. Under certain circumstances, Oculus also voluntarily accepts refunds. We explain below how the two refund rights apply to (I.) physical goods and (II.) digital content that you purchase through Oculus.

I. EU/EEA/UK Consumer Right of Withdrawal for Purchases of Physical Goods

Summary

Under applicable law, EU/EEA/UK consumers have a right to withdraw from certain purchases and return physical goods for a refund (as set out in “Full Text” below). Oculus also voluntarily accepts refunds as described in our Store Terms. We explain here how the two refund rights apply to physical goods you purchased through Oculus.

This right of withdrawal allows EU/EEA/UK consumers to withdraw from their purchase of physical goods within a period time, usually 14 days from delivery, and to return their purchase in exchange for a refund.

Separately, and without restricting the EU/EEA/UK right of withdrawal, Oculus voluntarily offers a return period to all customers worldwide. Within 30 days from the date of your receipt of the goods, you can return them so long as they were neither used nor stated by us to be non-returnable, which includes goods that were personalized or modified in accordance with your instructions. These rights are not the result of applicable law, but we provide these rights to you because we care about our users. Oculus is obligated as a merchant to inform you of the EU/EEA/UK right of withdrawal in very specific legal terms, which are below. If these terms in any way differ from our more informal “Summary” above, these terms shall prevail towards any EU/EEA/UK consumer.

If you have your habitual residence within a Member State of the European Union, of the European Economic Area, or in the UK and are entering into a contract with Facebook Technologies Ireland Limited as a consumer (i.e., for purposes which are outside your trade, business, craft or profession), you have the right to withdraw from the contract with Facebook Technologies Ireland Limited as described below.

Note that for contracts regarding the supply of digital content that is not supplied on a tangible medium (e.g., apps, videos, or other digital content that is provided for download), the rules for the EU right of withdrawal are different and are explained in section II. below.

Instruction on the Statutory Right of Withdrawal for Physical Goods

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of (a) the goods or, (b) in the case of a contract relating to multiple goods ordered by you in one order and delivered separately, the last good.

To exercise the right of withdrawal, you must inform us, Facebook Technologies Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, Attention: Oculus Customer Support of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post). You may use the below model withdrawal form, but it is not obligatory. You can also complete the below model withdrawal form and submit it or any other unequivocal statement on our website by following the instructions to Submit a Request at https://tickets.oculusvr.com/hc/requests/new?ticket_form_id=360000093291. If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g., by e-mail) without delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods to Teleplan Prague NA DLOUHEM 82 Gate 3 RICANY-JAZLOVICE 25101 Czech Republic (CZ), without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

II. EU/EEA/UK Consumer Right of Withdrawal for Purchases on the Oculus App Store

Summary

Under applicable law, EU/EEA/UK consumers have a right to withdraw from digital purchases (as set out in “Full Text” below), but this right is subject to exceptions. Oculus also has a refund policy to cover purchases on our Oculus app store. We explain here how the two apply to digital content you purchased through Oculus.

This right of withdrawal allows EU/EEA/UK consumers to withdraw from their purchase of software and content within a period time, usually 14 days. However, for digital downloads (like your app purchases through Oculus), this right can end when the consumer explicitly agrees for the download to begin and acknowledges the loss of the right of withdrawal.

Separately, and without restricting the EU/EEA/UK right of withdrawal, Oculus voluntarily offers a refund period to all customers worldwide. For most digital content, we allow you to try it out for two hours or less within 14 days. These rights are not the result of applicable law, but we provide these rights to you because we care about our users. This means that, even if you waive your EU/EEA/UK right of withdrawal by downloading and using your purchases immediately, you may still request a refund pursuant to our refund policy. The easiest and fastest way to request a refund is by visiting our online request system and selecting “Request to refund digital content.”

Note that for contracts regarding the supply of physical goods (e.g., Oculus devices), the rules for the EU/EEA/UK right of withdrawal are different and are explained in section I. above.
